Additionally, the bill permits the TWC to adopt rules for the acquisition process, including the option to use open-enrollment contracting methods to enroll multiple vendors if deemed beneficial for the state. If no responsive bids are received for a specific area, the TWC can negotiate with qualified vendors at market value for contracts not exceeding five years. The changes in law will apply only to acquisitions made after the effective date of the Act, which can take immediate effect with a two-thirds vote or will take effect on September 1, 2025, if not.
