H.B. No. 2694 amends the management structure and election procedures for the board of commissioners of the Brazoria Drainage District No. 4. The bill specifies that the board will consist of three commissioners, each holding an elected office designated as Place No. 1, Place No. 2, or Place No. 3. Elections for these positions will now occur on the uniform election date in May of odd-numbered years, replacing the previous schedule of November in even-numbered years. Additionally, the bill introduces a new provision stating that if a commissioner announces their candidacy for another office while their unexpired term exceeds one year and 30 days, it will result in an automatic resignation from their position.
The bill also modifies the process for filling vacancies on the board. It removes the previous requirement for commissioners to appoint a replacement if less than 290 days remain before the next regular election and instead mandates that vacancies be filled according to Section 49.105 of the Water Code. Furthermore, several subsections related to the election and appointment process have been repealed. The first elections under the new provisions are scheduled for May 2029 for Places No. 1 and No. 2, and May 2027 for Place No. 3, with terms for current commissioners expiring accordingly. The act will take effect immediately upon receiving a two-thirds vote from both houses or on September 1, 2025, if that threshold is not met.
