The Perinatal Palliative Care Act aims to ensure that pregnant women whose preborn children are diagnosed with life-threatening disabilities are informed about the availability of perinatal palliative care. The bill introduces a new subchapter to the Health and Safety Code, which defines perinatal palliative care as comprehensive support aimed at alleviating suffering for the pregnant woman, her preborn child, and their family. It mandates the development of informational materials and a list of perinatal palliative care providers, which must be made accessible on the commission's website. Health care providers are required to provide these materials to pregnant women at the time of diagnosis and to obtain a signed certification form confirming receipt of this information.
Additionally, the bill establishes disciplinary actions for health care providers who fail to comply with these requirements. Initial violations will result in a written warning, while subsequent violations will incur a $1,000 administrative penalty. The act is set to take effect on September 1, 2025.
