The bill amends Section 28.02(d) of the Penal Code to enhance the penalties for the offense of arson involving a government building. Specifically, it establishes that an arson offense is classified as a felony of the first degree if it is proven during the trial that the property intended to be damaged or destroyed includes a government building, in addition to a habitation. The previous language that included "a place of assembly or worship" has been deleted from the criteria for a first-degree felony.

The changes made by this bill will only apply to offenses committed on or after its effective date of September 1, 2025. Offenses that occur before this date will be governed by the law in effect at the time of the offense, ensuring that the former law remains applicable for those cases.
