House Bill No. 2642 amends Section 382.058(c) of the Health and Safety Code to clarify who is entitled to request a public hearing from the Texas Commission on Environmental Quality regarding the construction of a concrete plant. The bill introduces a definition for "representative," specifying that it refers to a person in a decision-making capacity with fiduciary responsibility or their designee. It also stipulates that only representatives of certain entities—such as schools, places of worship, licensed day-care centers, hospitals, or medical facilities—located within 440 yards of the proposed plant, as well as individuals residing within that same distance, may request a hearing as affected persons.
Additionally, the bill establishes that the changes will apply only to applications for permits submitted to the Texas Commission on Environmental Quality on or after the effective date of the Act. Applications submitted before this date will continue to be governed by the previous law. The Act is set to take effect immediately upon receiving a two-thirds vote from both houses of the legislature; otherwise, it will take effect on September 1, 2025.
