S.B. No. 1185 amends the Health and Safety Code to provide exemptions from boiler registration and inspection requirements for specific types of boilers used in medical equipment and autoclaves. The bill adds new categories of exemptions, including boilers that are components of medical devices regulated by the United States Food and Drug Administration, provided they meet certain size and pressure criteria. Specifically, these boilers must not exceed an inside shell diameter of 16 inches, 20 square feet of heating surface (unless electric), five cubic feet of gross volume (excluding casing and insulation), and an allowable working pressure of 100 pounds per square inch gauge. Additionally, unfired pressure vessels in autoclaves are also exempted.
The bill also modifies existing exemptions by removing the reference to steam cookers and adding espresso machines as a new category of exempt equipment. This legislative change aims to streamline regulations for smaller, non-commercial boilers and medical devices, thereby reducing the regulatory burden on manufacturers and operators in the healthcare sector. The act is set to take effect on September 1, 2025.
