The resolution, known as Jocelyn's Law, proposes an amendment to the Texas Constitution that mandates the denial of bail for illegal aliens charged with specific felony offenses. It defines an "illegal alien" as someone who entered the U.S. without proper inspection or failed to maintain lawful immigration status. The amendment applies to a range of serious offenses, including murder, aggravated kidnapping, sexual assault, and various drug-related crimes, among others. If a judge determines there is probable cause to believe the illegal alien committed one of these offenses, bail will be denied pending trial.

The proposed amendment will be presented to voters in a referendum scheduled for November 4, 2025. The ballot will allow voters to express their support or opposition to the constitutional change, which aims to enhance public safety by restricting bail for illegal aliens involved in serious criminal activities.
