S.B. No. 1123 amends Section 31.19 of the Penal Code to enhance the prosecution and punishment of theft of petroleum products. The bill introduces new provisions that increase the offense's category if certain conditions are met, such as if the offender organized or managed others in the crime, has prior convictions for similar offenses, engaged in conspiracy related to the theft, or possessed a firearm during the commission of the offense. However, if the offense is classified as a first-degree felony, the punishment cannot be increased under these new provisions. Additionally, the bill clarifies that if the conduct constitutes an offense under other laws, the individual may be prosecuted under this section, the other law, or both.

The changes made by this Act will only apply to offenses committed on or after its effective date of September 1, 2025. Offenses committed prior to this date will be governed by the existing law at that time, ensuring that the previous legal framework remains in effect for those cases.
