The bill amends the Water Code to update the notification process that municipalities must follow when they intend to provide water or sewer services in an incorporated or annexed area. Specifically, it removes the requirement for municipalities to notify retail public utilities in writing and allows for the notification to be sent via certified mail, hand delivery, or e-mail. Additionally, if a municipality does not execute an agreement with the retail public utility within 180 days of notifying them of its intent to provide service, the municipality must file an application for single certification with the utility commission before proceeding with service.
The changes introduced by this bill will only apply to proceedings affecting a certificate of public convenience and necessity that begin on or after the effective date of September 1, 2025. Any proceedings that started before this date will continue to be governed by the existing law.
