H.B. No. 2452 amends various sections of the Health and Safety Code and the Government Code to allow certain counties in Texas to provide solid waste disposal services under specific conditions. The bill permits a commissioners court to contract for solid waste services in areas within a municipality's extraterritorial jurisdiction if the municipality does not provide such services. The criteria for counties to engage in these contracts include having a population of over 1.5 million with at least 70% residing in a single municipality, or having a population of less than 1.3 million with a municipality of 750,000 or more. Additionally, the bill modifies the applicability of certain sections to reflect these population thresholds.
Furthermore, the bill introduces a criminal offense for individuals who intentionally or knowingly burn household refuse outdoors in specified unincorporated areas of counties that meet the outlined population criteria. The offense is defined based on the location of the burning and whether the county has established a mandatory solid waste program. The changes in law will only apply to offenses committed after the bill's effective date, which will be immediate if it receives a two-thirds vote from both houses, or otherwise will take effect on September 1, 2025.
