H.B. No. 2165 amends the Health and Safety Code and the Transportation Code to establish new requirements for motor vehicle emissions inspections in certain border counties in Texas. The bill specifies that the Texas Commission on Environmental Quality (TCEQ) must adopt vehicle emissions inspection and maintenance requirements for counties that either have a federal requirement or are formally requested by local resolutions. Additionally, it introduces a new category for counties that border the United Mexican States and contain an overweight corridor, mandating that these counties also have emissions inspection programs.

The bill further defines "overweight corridor" and mandates the TCEQ to create an emissions inspection and maintenance program specifically for vehicles in counties that meet the criteria of bordering Mexico and having an overweight corridor. The implementation of these requirements is to be carried out by the TCEQ and the Public Safety Commission as soon as practicable after the bill's effective date. The act will take effect immediately if it receives a two-thirds vote from both houses; otherwise, it will take effect on September 1, 2025.
