The bill amends the Water Code by adding Section 54.103, which establishes new regulations regarding the location of meetings for the board of directors of a municipal utility district. It stipulates that if less than 50 percent of the land area within a district has been developed, meetings must be held at a publicly accessible location either inside the district or within 10 miles outside of it. Conversely, if at least 50 percent of the land area has been developed, meetings should be held at a publicly accessible location within the district, unless five qualified electors petition the board to hold the meeting outside the district, in which case it can be held at a location not more than 10 miles away.
Additionally, the bill clarifies that the board is not prohibited from conducting open or closed meetings via telephone or video conference in accordance with existing government regulations. The act is set to take effect immediately upon receiving a two-thirds vote from both houses of the legislature, or on September 1, 2025, if such a vote is not achieved.
