The bill amends the Education Code and Government Code to establish regulations regarding public work contracts funded wholly or partly with state or local governmental money, or governmentally administered financial assistance. Specifically, it prohibits institutions and governmental entities from prohibiting, requiring, discouraging, or encouraging bidders, including contractors and subcontractors, from entering into agreements with collective bargaining organizations related to the project. Additionally, it forbids discrimination against individuals based on their involvement in such agreements, including their status as a party to the agreement or their willingness to enter into it.

The changes made by this Act will only apply to public work contracts for which solicitations are first published or distributed after the effective date of the Act. Contracts with solicitations published before this date will continue to be governed by the previous law. The Act will take effect immediately if it receives a two-thirds vote from both houses of the legislature; otherwise, it will take effect on September 1, 2025.
