H.B. No. 1951 amends the Education Code and Government Code to establish regulations regarding public work contracts funded wholly or partly with state or local governmental money, as well as governmentally administered financial assistance. The bill prohibits institutions and governmental entities from prohibiting, requiring, discouraging, or encouraging contractors or subcontractors from entering into agreements with collective bargaining organizations related to public work projects. Additionally, it prohibits discrimination against individuals based on their involvement in such agreements, including their status as a party to the agreement or their willingness to enter into it.

The changes made by this Act will only apply to public work contracts for which solicitations are published or distributed on or after the effective date of the Act. Contracts with solicitations published before this date will continue to be governed by the previous law. The Act will take effect immediately if it receives a two-thirds vote from all elected members in both houses; otherwise, it will take effect on September 1, 2025.
