The bill amends the Health and Safety Code to establish new regulations for air quality permits concerning concrete plants and crushing facilities. It prohibits the construction of certain facilities, specifically concrete crushing facilities and concrete plants that perform wet or dry batching, within 880 yards of specified buildings or areas, including residences, schools, and parks. The bill also outlines a series of requirements for the operation of permanent concrete plants, such as maintaining production records, equipping silos with filters, and ensuring that emissions do not exceed specified limits. Notably, it removes previous distance requirements related to the location of central baghouses from residences and other sensitive areas.

Additionally, the bill introduces new definitions and clarifications regarding the operation of concrete facilities, including the establishment of distance prohibitions for concrete crushing facilities from various types of buildings and outdoor areas. It allows for exceptions under certain conditions, such as existing facilities that were authorized before a specified date or those that meet specific operational criteria. The bill also repeals a section of the Health and Safety Code and specifies that the changes will apply only to permit applications filed after the effective date of the Act, which is set for September 1, 2025.
