The bill, S.B. No. 807, aims to enhance the prosecution of fraudulent use or possession of credit card or debit card information in Texas. It introduces a new provision, Article 13A.2551, to the Code of Criminal Procedure, allowing such offenses to be prosecuted in any county where the crime occurred or in the county of residence of the victim whose card information was unlawfully obtained, possessed, transferred, or used. This change is intended to provide greater flexibility in the prosecution of these offenses.

Additionally, the bill amends Article 38.19(a) of the Code of Criminal Procedure to include Section 32.315 (Fraudulent Use or Possession of Credit Card or Debit Card Information) among the offenses applicable to certain trial procedures. The changes will only apply to criminal proceedings that commence on or after the effective date of the Act, which is set for September 1, 2025. Proceedings that began before this date will continue to be governed by the previous law.
