The bill, S.B. No. 796, introduces a new section to the Health and Safety Code regarding the construction of concrete batch plants. It allows the executive director to grant a single extension of up to 90 days for individuals authorized under a standard permit to begin construction of a concrete plant that performs wet batching, dry batching, or central mixing. If the individual fails to commence construction within the allotted time, they must submit a new application for authorization to use the standard permit. Additionally, upon receiving a request for an extension, the executive director is required to notify the state senator and representative for the area where the facility will be located.
The Texas Commission on Environmental Quality is mandated to adopt necessary rules to implement these changes by September 1, 2026. The new provisions will only apply to applications for standard permits filed on or after the effective date of the Act, which is set for September 1, 2025. Applications submitted before this date will be governed by the existing laws in effect at that time.
