The bill amends Section 1201.008 of the Occupations Code to enhance the regulation of new HUD-code manufactured housing in Texas. It stipulates that municipalities must allow the installation of HUD-code manufactured homes in designated areas, including subdivisions and rental communities, and that applications for such installations are automatically granted unless denied in writing within 45 days. Additionally, local governmental units are prohibited from requiring permits, fees, bonds, or insurance for the transportation and installation of manufactured homes by licensed retailers or installers, although they can charge for actual costs incurred during transportation.
Furthermore, the bill introduces new provisions that prevent municipalities from unreasonably regulating or restricting the installation of new HUD-code manufactured homes. It specifies that municipalities cannot require specific use permits for homes built in compliance with federal law and mandates that municipalities with zoning regulations must allow the installation of these homes in at least one residential zoning classification. They are also prohibited from enacting regulations that would effectively ban the installation of new HUD-code manufactured homes across all residential zones. The act is set to take effect on September 1, 2025.
