The bill amends Sections 382.065(a) and (b) of the Health and Safety Code to establish new regulations regarding the operation of concrete crushing facilities near hospitals, in addition to existing restrictions near residences and schools. Specifically, the bill prohibits the operation of such facilities within 440 yards of a building used as a single or multifamily residence, school, hospital, or place of worship at the time a permit application is filed. The distance measurement is defined as the shortest distance from the facility to the nearest point of the residence, school, hospital, or place of worship. Additionally, the bill clarifies that the new restrictions do not apply to facilities that were authorized before September 1, 2001, or to those that meet the distance requirements at the time of their initial permit application, even if a residence, school, hospital, or place of worship is later built nearby. The bill also includes specific provisions for facilities that use concrete crushers in the manufacture of products containing recycled materials, provided they meet certain location criteria. The new regulations will take effect on September 1, 2025, and will only apply to permit applications filed after that date.
