The bill amends the Family Code to clarify the jurisdiction of juvenile courts over individuals involved in certain legal proceedings, regardless of their age, as long as specific conditions are met. It stipulates that the court retains jurisdiction if the petition or motion was filed while the respondent was under 18 or 19 years of age, the proceedings are not completed before they reach that age, and the court finds that either the prosecuting attorney exercised due diligence to complete the proceedings or the delay was not the fault of the state.
Additionally, the bill modifies the conditions under which juvenile records can be sealed. It specifies that a court cannot seal records for individuals who received a determinate sentence for certain serious offenses or are required to register as sex offenders. However, it introduces a provision allowing the sealing of records for individuals placed on determinate sentence probation under specific conditions, such as not being committed to the Texas Juvenile Justice Department for the conduct in question and having been discharged from probation. The changes will apply only to conduct occurring on or after the bill's effective date of September 1, 2025.
