No. 732, mandates that certain multifamily residential developments, specifically those that receive low-income housing tax credits and are designated for individuals aged 55 and older, must be equipped with a generator or alternative power source. This power source must be capable of operating elevators that provide the only access to residential units and maintaining air temperatures between 68 and 82 degrees Fahrenheit during power outages. Additionally, the Texas Department of Housing and Community Affairs is authorized to establish a process for development owners to obtain a five-year waiver from this requirement if compliance would impose an undue hardship.

The bill outlines that developments completed on or after January 1, 2026, must comply with these requirements, while those completed by December 31, 2025, will have until January 1, 2030, to comply. Furthermore, the Texas Department of Housing and Community Affairs is tasked with reporting to the legislature by March 1, 2030, on compliance rates and reasons for any noncompliance. The act is set to take effect on September 1, 2025.
