S.B. No. 732 introduces a new requirement for certain housing developments that receive low-income housing tax credits. Specifically, it mandates that multifamily residential developments reserved for individuals aged 55 and older must be equipped with a generator or other power source. This power source must be capable of operating elevators that provide the only access to residential units and maintaining air temperatures between 68 and 82 degrees Fahrenheit during power outages. The Texas Department of Housing and Community Affairs is tasked with enforcing this requirement and may establish a process for development owners to obtain a five-year waiver if compliance would cause undue hardship.

The bill also outlines compliance timelines, stating that developments completed on or after January 1, 2026, must adhere to these requirements, while those completed by December 31, 2025, have until January 1, 2030, to comply. Additionally, the Texas Department of Housing and Community Affairs is required to submit a report to the legislature by March 1, 2030, detailing compliance status and reasons for any noncompliance. The act is set to take effect on September 1, 2025.
