H.B. No. 1734 amends Section 155.207(a) of the Family Code to streamline the process for transferring court files in cases affecting the parent-child relationship when continuing, exclusive jurisdiction is transferred to another court. The bill requires the clerk of the transferring court to send, within ten working days of the order of transfer, a series of documents to the receiving court using the electronic filing system. Notably, the bill adds the requirement to include "pleadings in the pending proceeding and any other document specifically requested by a party," while removing the previous requirement for "original papers filed in the transferring court."
The changes made by this Act will only apply to suits where the order transferring jurisdiction is rendered on or after the effective date of September 1, 2025. For cases where the transfer order was issued before this date, the existing law will remain in effect. This legislative update aims to enhance the efficiency and clarity of the transfer process in family law cases.
