H.B. No. 1732 amends the Occupations Code to establish stricter regulations regarding the eligibility and licensing of massage therapists, massage therapy instructors, and massage establishments. Specifically, it states that individuals are ineligible for a license if they have been convicted of, or have entered a plea of nolo contendere or guilty to, certain offenses. The bill expands the list of disqualifying offenses to include additional sections of the Penal Code, specifically Sections 22.011, 22.012, 22.021, 43.021, 43.03, 43.031, 43.04, 43.041, or 43.05, while removing references to Chapter 20A and certain other sections.
Additionally, the bill mandates that the Texas Commission of Licensing and Regulation revoke the licenses of massage therapists or instructors who are convicted of offenses described in the newly amended Section 455.152 or who are found to have practiced massage therapy at or for a sexually oriented business. The commission is required to adopt necessary rules to implement these changes as soon as practicable after the bill's effective date, which is set for September 1, 2025.
