H.B. No. 1667 amends the Texas Labor Code to enhance the eligibility of certain first responders for workers' compensation benefits specifically related to post-traumatic stress disorder (PTSD). The bill redefines the criteria for compensable injuries by transferring and redesignating Section 504.019 to Section 408.0061, which outlines that PTSD is compensable for first responders only if it is diagnosed as being caused by events occurring in the course of their employment. The definition of "first responder" is expanded to include individuals employed by the state, political subdivisions, or institutions of higher education, and specifies various roles such as peace officers, emergency medical personnel, and firefighters.
Additionally, the bill clarifies that a mental or emotional injury arising from legitimate personnel actions is not compensable, and it establishes that the date of injury for PTSD claims is when the first responder becomes aware that their condition may be related to their employment. The changes in law will apply only to claims for injuries occurring on or after the effective date of the Act, which is set for September 1, 2025.
