The bill, S.B. No. 639, amends the Human Resources Code to enhance the eligibility criteria for the Supplemental Nutrition Assistance Program (SNAP) benefits in Texas. It introduces two new sections: Section 33.016 establishes that individuals whose eligibility for SNAP benefits has been initially established or recertified will remain eligible for a period of 12 months. The Texas Health and Human Services Commission is authorized to adjust this eligibility period to align with the recertification of medical assistance for children in the same household. However, this provision does not apply to individuals who expect a change in circumstances within six months, those aged 60 or older or with disabilities living in households where all members meet certain criteria, or those in households with specific age and dependency conditions.

Additionally, Section 33.0215 mandates an annual inflation adjustment for resources excluded when determining SNAP eligibility. The executive commissioner is required to adjust the maximum amount for excluded resources based on the Consumer Price Index, with the first adjustment reflecting changes since July 1, 2001, and set to expire on October 1, 2026. The changes in law will apply to eligibility determinations made on or after the effective date of the Act, which is September 1, 2025. If a state agency requires federal authorization for implementation, it may delay the provision until such authorization is granted.
