This bill amends the Human Resources Code by adding two new sections that establish guidelines for the eligibility of individuals for Supplemental Nutrition Assistance Program (SNAP) benefits. Section 33.016 mandates that individuals whose eligibility has been established or recertified will remain eligible for a period of 12 months. It also allows the commission to adjust this eligibility period to align with the recertification of medical assistance for children in the same household. However, this section does not apply to individuals who expect a change in circumstances that would affect their eligibility, those who are 60 years or older or have a disability and live in a household where all members meet certain criteria, or those who reside with individuals aged 18 to 50 without dependents or disabilities.
Additionally, Section 33.0215 introduces an annual inflation adjustment for resources excluded from determining SNAP eligibility. The executive commissioner is required to adjust the maximum amount of these excluded resources based on the Consumer Price Index, with the first adjustment reflecting changes since July 1, 2001, and set to expire on October 1, 2026. The changes in law will apply to eligibility determinations made on or after the effective date of the Act, which is September 1, 2025. If a state agency requires federal authorization for implementation, it may delay the provision until such authorization is granted.
