H.B. No. 1584 proposes the establishment of a list of priority facilities by electric utilities in Texas. The bill defines "priority facility" to include essential services such as hospitals, police stations, fire stations, critical water or wastewater facilities, and confinement facilities operated by the Texas Department of Criminal Justice. Electric utilities are required to maintain this list within their retail service areas and provide a mechanism on their websites for facilities to request inclusion on the list. If a facility requests to be added, the utility must confirm whether it qualifies as a priority facility within 14 days.
Additionally, the bill mandates that in the event of a natural disaster or emergency declared by the governor, electric utilities must provide the list of priority facilities to the Texas Division of Emergency Management. The submitted list will be confidential and exempt from disclosure under the Government Code. This legislation is set to take effect on September 1, 2025.
