H.B. No. 1584 establishes a new requirement for electric utilities in Texas to create and maintain a list of "priority facilities" within their retail service areas. The bill mandates that electric utilities provide a mechanism on their websites for facilities to request inclusion on the priority facility list, and they must disclose whether a facility is on the list within 14 days of a request.
Additionally, in the event of a natural disaster or emergency declared by the governor, electric utilities are required to provide the list of priority facilities to the Texas Division of Emergency Management. The bill also stipulates that this list is confidential and not subject to public disclosure under the Government Code. The commission may implement further processes to protect consumer information related to this section. The act is set to take effect on September 1, 2025.
