H.B. No. 1584 establishes a new requirement for electric utilities in Texas to create and maintain a list of "priority facilities" within their retail service areas. A priority facility is defined as either a facility already listed in Section 38.072(b) or one deemed crucial for public safety, which includes hospitals, police stations, fire stations, critical water or wastewater facilities, and confinement facilities operated by the Texas Department of Criminal Justice. The bill mandates that electric utilities provide specific information about each priority facility, including its name, type, and address, and create a mechanism on their websites for facilities to request inclusion on the list.

Additionally, the bill stipulates that electric utilities must respond to requests from facilities regarding their status on the priority facility list within 14 days. In the event of a natural disaster or emergency declared by the governor, utilities are required to provide the list to the Texas Division of Emergency Management, which will keep the information confidential and exempt from public disclosure under Chapter 552 of the Government Code. The bill is set to take effect on September 1, 2025.
