The bill amends the Family Code and Human Resources Code to establish specific timelines and responsibilities for the Texas Juvenile Justice Department (TJJD) regarding the custody of individuals committed to the department. It mandates that the TJJD must accept custody of a person within 30 days of a judge signing the disposition order. If the department fails to do so, it is required to compensate the county for the costs incurred for each day the individual remains in detention beyond this period. This compensation must equal the amount that the department would have incurred for the same duration.
Additionally, the bill introduces a provision that allows the TJJD to credit time spent in a pre-adjudication secure detention facility toward the minimum length of stay for the child, starting from the 31st day after the commitment. This change aims to ensure that the time spent in detention prior to transfer is recognized in the overall assessment of the child's stay with the department. The bill is set to take effect on January 1, 2026.
Statutes affected: Introduced: Family Code 54.04, Human Resources Code 243.002 (Human Resources Code 243, Family Code 54)
