S.B. No. 466 amends the definition of "fetal death certificate" in the Texas Health and Safety Code. The bill specifies that a fetal death certificate is to be filed for any fetus weighing 350 grams or more, or if the weight is unknown, for a fetus that is 20 weeks or older based on the last normal menstrual period. Additionally, the bill allows for a fetal death certificate to be issued for a fetus of any weight or gestational age if a family member requests it.
The changes made by this bill expand the criteria under which a fetal death certificate can be issued, thereby providing more families the opportunity to formally recognize the loss of a fetus. The bill is set to take effect immediately upon receiving a two-thirds vote from both houses of the legislature, or on September 1, 2025, if such a vote is not achieved.
