S.B. No. 401 amends the Education Code to clarify the participation of non-enrolled students in University Interscholastic League (UIL) activities. The bill allows public schools to provide non-enrolled students, who meet league eligibility standards, the opportunity to participate in UIL activities in the same manner as enrolled students. However, it introduces a provision that permits school districts or open-enrollment charter schools to adopt a policy that declines participation for non-enrolled students. Additionally, the bill specifies that non-enrolled students can only participate in activities for the school they would be eligible to attend based on their residential address, unless that school has a policy against such participation, in which case the student may join the closest school not subject to that policy.

The amendments include the addition of new subsections (c-2) and (e-1), which outline the conditions under which non-enrolled students may participate in UIL activities. The bill is set to take effect for the 2025-2026 school year, with provisions for immediate effect if it receives a two-thirds vote from both houses of the legislature.
