The bill amends Section 382.058(c) of the Health and Safety Code to expand the authority of municipalities and counties regarding the construction of concrete plants. Specifically, it allows both the municipality or county in which the proposed plant will be located and individuals residing within 440 yards of the proposed site to request a hearing from the Texas Commission on Environmental Quality. This change replaces the previous provision that limited the request for a hearing to only those individuals actually residing within the specified distance from the proposed plant.

The bill stipulates that the changes will apply only to applications for permits submitted to the Texas Commission on Environmental Quality on or after the effective date of the Act, which is set for September 1, 2025. Applications submitted prior to this date will continue to be governed by the existing law.
