S.B. No. 371 amends the Education Code to require public schools in Texas to obtain written parental consent before a student can participate in human sexuality instruction. The new provision, added as Subsection (i-2) to Section 28.004, stipulates that the request for consent must be separate from any other notifications or consent requests sent to parents, except for the notice required under Subsection (i). Additionally, the request for written consent must be provided to parents at least 14 days prior to the commencement of the instruction.

The bill is set to take effect at the beginning of the 2025-2026 school year, and it will be enacted immediately if it receives a two-thirds majority vote from both houses of the Texas Legislature. If not, the bill will take effect on September 1, 2025.
