The bill amends Section 25.0344 of the Education Code to expand the eligibility for public school student transfers to include children of certain public servants. The new language specifies that the term "parent" now includes individuals standing in a parental relation to a student, and it introduces definitions for "peace officer," "prosecuting attorney," and "servicemember." Additionally, it adds federal judges, state judges, county court judges, justices of the peace, and judicial officers to the list of eligible public servants whose children can request a transfer.
Under the amended law, when a parent who is a peace officer, prosecuting attorney, servicemember, or a judicial officer requests a transfer, the school district must accommodate the transfer to another campus or school district as per the parent's selection. However, the school district is not obligated to provide transportation for the student transferring under this provision. The bill is set to take effect for the 2025-2026 school year, with immediate effect possible if it receives the necessary legislative approval.
