The bill, S.B. No. 349, mandates that public schools in Texas provide reasonable accommodations for lactating students at the middle and high school levels. Specifically, it requires the board of trustees of each school district, as well as the governing boards of the Texas School for the Blind and Visually Impaired, the Texas School for the Deaf, and open-enrollment charter schools, to facilitate the needs of lactating students. These accommodations include allowing students to express breast milk, breast-feed an infant child, and address other related needs.

The new section, 38.044, is added to Subchapter A, Chapter 38 of the Education Code, and the provisions of this act will take effect starting with the 2025-2026 school year. The bill will become effective immediately if it receives a two-thirds majority vote in both houses; otherwise, it will take effect on September 1, 2025.
