The bill, S.B. No. 349, mandates that public schools in Texas provide reasonable accommodations for lactating students at the middle and high school levels. Specifically, it requires the board of trustees of each school district, as well as the governing boards of the Texas School for the Blind and Visually Impaired, the Texas School for the Deaf, and open-enrollment charter schools, to facilitate the needs of lactating students. These accommodations include allowing students to express breast milk, breast-feed an infant child, and address other related needs.

The new legal language added to the Education Code includes Section 38.044, which outlines these requirements. The bill is set to take effect at the beginning of the 2025-2026 school year, and it will become effective immediately if it receives a two-thirds majority vote from both houses of the Texas Legislature; otherwise, it will take effect on September 1, 2025.
