S.B. No. 226 amends the Education Code and Family Code in Texas to establish residency requirements for children under parental child safety placement agreements for public school admission. The bill introduces a new provision in Section 25.001 of the Education Code, allowing a parent or guardian to establish residency by providing a letter from the Department of Family and Protective Services. This letter must confirm that the child is under such an agreement and specify the child's residence address within the school district. Additionally, a new requirement is added to Section 264.902 of the Family Code, mandating that parental child safety placement agreements for school-age children include a letter from the department that serves as proof of residence for school enrollment.

The provisions of this bill will take effect starting with the 2025-2026 school year and will apply only to parental child safety placement agreements executed on or after the effective date of the Act. Agreements made prior to this date will continue to be governed by the existing law. The bill is set to take effect immediately if it receives a two-thirds majority vote in both houses; otherwise, it will take effect on September 1, 2025.
