The bill amends Section 28.02(d) of the Penal Code to enhance the penalties for the offense of arson involving government buildings. Specifically, it establishes that arson is classified as a felony of the first degree if the property intended to be damaged or destroyed is a government building, in addition to a habitation. The previous language that included "a place of assembly or worship" has been deleted from the statute.

The changes made by this Act will only apply to offenses committed on or after its effective date of September 1, 2025. Offenses that occurred before this date will be governed by the law in effect at the time of the offense, ensuring that the former law remains applicable for those cases.
