H.B. No. 1185 introduces a new requirement for landlords in Texas regarding notice of rent increases to residential tenants. The bill mandates that landlords provide written notice to tenants at least seven days before the tenant is required to give notice to vacate at the end of their lease term. This notice must include the new rent amount, any improvements made to the rental unit that justify the increase, and the effective date of the rent increase. If a landlord fails to provide this notice, they are restricted from requiring the tenant to vacate or increasing the rent until certain conditions are met.

Additionally, the bill stipulates that if a landlord does not comply with these notice requirements, the tenant is entitled to a penalty of $100. The provisions of this bill will apply only to lease agreements entered into or renewed on or after the effective date of the Act, which is set for September 1, 2025.
