House Bill No. 1093 amends the Texas Property Code to update the requirements for notice advertising the sale of property to enforce a self-service storage facility lien. The bill specifies that if a tenant fails to satisfy a claim within 14 days of receiving notice, the lessor must either publish or post notices advertising the sale or give notice in a commercially reasonable manner. The amendments clarify the timeline for when a lessor can sell the property based on the method of notice, including a new provision that allows for sales to occur 10 days after notice is given in a commercially reasonable manner.

Additionally, the bill modifies the method and content of the notice advertising the sale. It allows lessors to publish notices in a newspaper or on a publicly accessible Internet website that regularly advertises auctions of personal property. If no newspaper exists in the county, the lessor can post notices at the storage facility and five other locations. The bill also establishes that notice is considered commercially reasonable if at least three independent bidders register for or attend the sale. These changes will apply only to rental agreements entered into, extended, or renewed after the bill's effective date of September 1, 2025.
