H.B. No. 1052 amends the Texas Insurance Code to enhance health benefit plan coverage for telemedicine, teledentistry, and telehealth services when the originating or distant site is located outside the state. The bill introduces new definitions, including "distant site," which refers to the location where a health professional provides telehealth services, and "originating site," where an individual receives these services. Additionally, it defines "health professional" to include physicians, dentists, and other licensed individuals authorized to assist in delivering telehealth services.

The bill mandates that health benefit plans must provide coverage for telehealth services delivered from outside Texas on the same terms as those delivered within the state, provided that the individual receiving the service primarily resides in Texas and the health professional is licensed in Texas and has a physical office in the state. This provision will take effect for plans delivered, issued, or renewed on or after January 1, 2026, while plans renewed before this date will continue to be governed by existing law. The act is set to take effect on September 1, 2025.
