The Texas COVID-19 Vaccine Freedom Act establishes new requirements for informed consent regarding COVID-19 vaccinations. It prohibits any person from compelling or coercing individuals lawfully residing in Texas to receive a COVID-19 vaccine against their preference. Additionally, health care providers are mandated to obtain informed consent from individuals before administering a COVID-19 vaccine. The bill defines "informed consent" and outlines that an individual lacks the capacity to provide such consent if they have been coerced into vaccination.

Furthermore, the Act stipulates that individuals cannot face adverse actions or penalties for refusing or failing to obtain a COVID-19 vaccine. The Texas Attorney General is granted the authority to seek injunctive relief against violators of this section, and health care providers who fail to obtain informed consent may be liable for damages of at least $5,000. The provisions of this Act will apply only to conduct occurring after its effective date, which is immediate upon a two-thirds vote or on September 1, 2025, if such a vote is not achieved.
