This bill amends the Water Code to update the terminology related to the Texas Natural Resource Conservation Commission, changing its name to the Texas Commission on Environmental Quality. It also introduces a new requirement for the creation of municipal utility districts in certain counties. Specifically, before a petition for the creation of a proposed district can be filed, the commissioners court of each county where the district is to be located must receive a notice by certified mail. This notice must describe the proposed district's boundaries and inform the court of its rights to respond, review the petition, and submit a written opinion regarding the district's creation.
Additionally, the bill specifies that the petition for creating a municipal utility district must include a copy of the notice sent to the commissioners court, ensuring that local authorities are adequately informed and involved in the process. The new provisions will apply only to petitions filed on or after the effective date of the bill, which is set for September 1, 2025. This legislative change aims to enhance transparency and local engagement in the establishment of municipal utility districts.
