The bill amends Texas law to establish limitations on public health directives issued during a state of disaster or outbreak of a communicable disease. It introduces two new sections: Section 418.0165 in the Government Code and Section 81.018 in the Health and Safety Code. Both sections stipulate that the governor, as well as the department or health authority, may issue public health directives only if those directives are not more stringent than any public health directive for undocumented immigrants issued by the United States Immigration and Customs Enforcement.

These changes aim to ensure that public health measures taken during emergencies align with federal guidelines regarding undocumented immigrants. The bill specifies that the new provisions will apply only to directives issued on or after the effective date of the Act, which can be immediate if it receives a two-thirds vote from both houses of the legislature, or it will take effect on September 1, 2025, if not.
