The bill, H.B. No. 582, amends Section 3100.104 of the Government Code to establish proper etiquette during the recitation of the pledge of allegiance to the state flag. The new language specifies that individuals not in uniform should face the state flag and stand at attention with their right hand either over their heart or extended toward the flag at waist level, with the elbow bent and palm facing upward. Additionally, it clarifies that if a person is wearing a head covering that is easy to remove, they should take it off with their right hand and hold it at their left shoulder while keeping their hand over their heart.
The bill also outlines the behavior expected from different groups during the pledge. Members of the armed forces or veterans not in uniform may make a military salute while reciting the pledge, while those in uniform are instructed to remain silent, face the flag, and perform the military salute. The act will take effect immediately if it receives a two-thirds vote from both houses; otherwise, it will take effect on September 1, 2025.
