The bill amends the Government Code to clarify the conditions under which certain rules proposed by state agencies can be adopted and voided. Specifically, it modifies Section 2001.0045(c) to exclude rules related to state agency procurement, those that reduce burdens or costs for regulated persons, rules adopted in response to natural disasters, and those necessary for federal compliance or to protect water resources. Notably, it removes the previous requirement that rules must also protect the health, safety, and welfare of residents. Additionally, it introduces new provisions that allow rules adopted by self-directed semi-independent agencies to be exempt from certain procedural requirements.
Furthermore, the bill amends Sections 2001.035(a) and (b) to establish that a rule is voidable unless adopted in substantial compliance with the specified sections of the Government Code. It also sets a two-year deadline for individuals to contest a rule based on noncompliance with procedural requirements. The changes will only apply to rules proposed on or after the effective date of the Act, which is set for September 1, 2025.
