H.B. No. 549, also known as the Westyn Bryan Mandrell Act, mandates that each public school district in Texas must provide at least one airway clearance device on each campus to assist students experiencing foreign-body airway obstructions. The bill defines an "airway clearance device" as a noninvasive tool for this purpose and outlines that the device must be stored in a location determined by the campus principal, ideally near where students eat. Compliance with this requirement is contingent upon the district's ability to obtain the device through donation or purchase using allocated funds. Additionally, the bill requires that trained personnel be present at the location of the device whenever a significant number of students are present.
Furthermore, the bill allows school districts and charter schools to contract with vendors for medication and training related to respiratory distress. This includes providing necessary medication and equipment, as well as training for school personnel and volunteers authorized to administer such medication. The provisions of this act will take effect starting with the 2025-2026 school year, and it may be enacted immediately if it receives a two-thirds majority vote from both houses of the legislature.
