The bill amends the Local Government Code and the Property Code to establish regulations regarding the raising or keeping of chickens on single-family residential lots. Specifically, it allows municipalities and property owners' associations to permit the raising of six or fewer chickens, prohibiting any ordinances or restrictive covenants that would prevent this. Municipalities can impose reasonable regulations that do not effectively prohibit the keeping of these chickens, such as limits on the number of additional chickens, prohibitions on breeding or keeping roosters, and requirements for the distance between chicken coops and residential structures.
Additionally, the bill specifies that any restrictive covenant created by a property owners' association after September 1, 2025, cannot prohibit the raising of six or fewer chickens. Similar to municipalities, property owners' associations can enforce reasonable requirements that do not prevent the keeping of these chickens. Any provision that violates this allowance is deemed void. The bill is set to take effect immediately upon receiving a two-thirds vote from both houses or on September 1, 2025, if such a vote is not achieved.
