The bill amends Section 17.46(b) of the Business & Commerce Code to include new provisions addressing deceptive trade practices specifically related to the sale of animals. It introduces a new clause that prohibits sellers from knowingly selling or offering for sale an animal that is sick without disclosing the existence and extent of the sickness. Additionally, it makes it unlawful to provide false or misleading health records or information regarding health screenings related to the animal being sold or offered for sale.
The bill also deletes a previous provision regarding vehicle protection product warranties and adds the new clause as item (35) in the list of deceptive acts. The changes will take effect on September 1, 2025, and will only apply to acts or practices occurring on or after that date, ensuring that any actions taken before the effective date will be governed by the law in effect at that time.
