H.B. No. 451 amends the Family Code and Human Resources Code to enhance the screening processes for children at risk of commercial sexual exploitation. Specifically, it requires that within 45 days of a child entering the conservatorship of the Department of Family and Protective Services, they must receive a comprehensive assessment that includes a screening for trauma and interviews with individuals knowledgeable about the child's needs. Additionally, a new requirement is introduced for a screening for the risk of commercial sexual exploitation using a validated, evidence-informed tool, which must be selected by the Child Sex Trafficking Prevention Unit. This screening is mandated if validation guidelines indicate it is appropriate based on the child's age or if there are existing concerns about commercial sexual exploitation.

Furthermore, the bill mandates that juvenile probation departments conduct a risk and needs assessment for each child under their jurisdiction, which must also include a screening for the risk of commercial sexual exploitation using the same validated tool. The implementation of these provisions is contingent upon the legislature appropriating specific funds for this purpose; if such funds are not allocated, the department may choose to implement the provisions using other available resources. The act is set to take effect on September 1, 2025.
