The bill amends the Water Code to establish new requirements for the creation of municipal utility districts in Texas. It updates the definition of the "Commission" to refer to the Texas Commission on Environmental Quality instead of the Texas Natural Resource Conservation Commission. Additionally, it introduces a new section, 54.0135, which mandates that applicants must file a draft of their petition with the county clerk of each county where the proposed district will be located at least 30 days before submitting the official petition to the commission.
Furthermore, the bill modifies Section 54.015 to require that the petition for a municipal utility district must be accompanied by evidence that the draft was timely filed with the county clerk, as stipulated in the new Section 54.0135. An affidavit can be submitted to satisfy this requirement. The provisions of this bill will apply only to petitions filed on or after its effective date of September 1, 2025, while petitions filed before this date will continue to be governed by the previous law.
