The bill amends the Texas Water Code to enhance the process for creating municipal utility districts (MUDs) in certain counties. It updates the definition of the "Commission" to refer to the Texas Commission on Environmental Quality instead of the Texas Natural Resource Conservation Commission. Additionally, it introduces a new section, 54.0135, which mandates that before filing a petition for the creation of a proposed district, notice must be sent via certified mail to the commissioners court of each county where the district is to be located. This notice must describe the proposed district's boundaries and inform the court of its rights to respond, review the petition, and submit an opinion on the district's creation.
Furthermore, the bill modifies the contents of the petition for creating a MUD by requiring that it includes a copy of the notice sent to the commissioners court, specifically for districts described by Section 54.0161(a). The changes apply only to petitions filed on or after the effective date of the Act, which is set for September 1, 2025. Petitions filed before this date will continue to be governed by the previous law.
