H.B. No. 370 amends Section 478.0051 of the Texas Events Trust Fund to establish new eligibility criteria for events seeking funding. The bill introduces subsections (d) and (e), which state that an event is ineligible for funding if it allows biological males to compete in sports designated for female athletes. Additionally, it defines an athlete's status as a biological male based on the biological sex indicated on their official birth certificate or another government record if the birth certificate is unobtainable. The bill also clarifies that a birth certificate's statement of biological sex is considered accurate only if it was entered at or near the time of birth or modified to correct clerical errors.

Furthermore, the bill specifies that the new eligibility criteria do not prevent biological males from serving as coaches, support staff, or other personnel who are not actively competing in female-designated sports. The act is set to take effect immediately upon receiving a two-thirds vote from both houses of the legislature or on September 1, 2025, if such a vote is not achieved.
