The bill, H.B. No. 314, amends the Human Resources Code by adding a new section that establishes a 12-month eligibility period for individuals receiving supplemental nutrition assistance program (SNAP) benefits. The Texas commission is tasked with ensuring that once an individual's eligibility is established or recertified, they will remain eligible for benefits for a full year. Additionally, the commission has the authority to adjust this eligibility period to align with the recertification of medical assistance program benefits for children in the same household. However, this provision does not apply to individuals who expect a change in circumstances that would affect their eligibility within six months, those who are 60 years or older or have a disability and live in a household where all members are similarly situated, or those who reside with individuals aged 18 to 50 without dependents or disabilities.

The changes made by this bill will apply to any initial determination or recertification of eligibility for SNAP benefits occurring on or after the effective date of the Act, which is set for September 1, 2025. Furthermore, if a state agency finds that federal authorization is needed to implement any part of the bill, it may delay implementation until such authorization is obtained.
