The bill amends Section 46.003 of the Government Code to address the total annual salary limits for certain state prosecutors. It introduces a new provision, Subsection (c-1), which states that the salary limitation imposed by Subsection (c) does not apply to state prosecutors serving in judicial districts or counties with populations of less than 400,000. This means that these prosecutors will not face salary reductions based on the maximum combined base salary limits set for district judges.
Additionally, the bill maintains the existing requirement that if a state prosecutor's total annual salary from state and county sources exceeds the maximum combined base salary for a district judge with comparable years of service, the comptroller must reduce the prosecutor's state annual salary by the excess amount. However, the reduction cannot bring the salary below the state base salary for district judges as established by the General Appropriations Act. The bill is set to take effect on September 1, 2025.
